Terms of Business

These terms of business are to protect and clarify the legal rights of our customers as well as ourselves.

1. Prevailing terms:
a) The terms and conditions stated below apply to all upholstered furniture and fabric orders made to Harlands Organic Furnishings. No other terms and conditions can apply in any circumstances.

2. Customers:
a) We sell both trade and retail.
b) All business will be conducted on a pro-forma basis.

3. Pricing:
a) Prices are subject to change. We will be pleased to quote the current price immediately prior to an order being placed.

4. Statement of liability:
a) All goods supplied by Harlands Organic Furnishings are supplied on the condition that our liability for any fault or defect in the quality, condition, description or fitness for any purpose is to a sum not exceeding the purchase price of the particular good. That condition supersedes any conflicting term submitted to us and all other liability whether statutory or otherwise is excluded.

5. Products:
a) We reserve the right to withdraw items from our range at any time without prior notification.
b) There is a minimum order length of varying lengths ( see info with each fabric) for fabric or one roll for wallpaper.
c) Minimum orders for goods made-to-order will be notified when an order is placed.
d) All orders must be in writing confirming the product name and colour unless ordered online through the website.
f) Samples remain the property of Harlands Organic Furnishings. They must be returned within 21 days of receipt otherwise they will be invoiced at £12 per sample.
g) Colour or finish matching: for exact colour or finish matching request a stock cutting as colours and finishes can vary from batch to batch.
h) Fitness for purpose: the buyer must satisfy themselves that any product supplied by Harlands Organic Furnishings is fit for the purpose for which it is purchased for prior to ordering.
i) Wallpapers must be checked prior to cutting and hanging.

6. Payment:
a)Payment in full is required for all fabrics, wallpaper and furniture prior to confirming order.
b) Payment in full for all fabric orders is required before goods are cut and dispatched.
c) Delivery times for fabrics, wallpaper and furniture will vary and Harlands Organic Furnishings will give estimated dates of delivery prior to order being placed.
d) Pro-forma invoices must be fully paid before goods are delivered.
e) Once full payment is received the goods become the property of the buyer.

7. Delivery:
a) The full delivery address must be given when the order is placed.
b) It is the buyers responsibility to check for any damages to packing materials and product before excepting delivery of the products, and to report any damage by delivery company within 48 hours. In the unlikely event that there is any damage, please DO NOT accept delivery, DO NOT sign the delivery sheet, instead ask the driver for a damaged freight report which will need your signature. Contact us as soon as possible. Goods are not covered by transit insurance once you have accepted delivery.
c) It is the responsibility of the buyer to ensure that the correct product has been delivered to any other third party such as an upholsterer or curtain maker.
d) Delivery dates supplied by Harlands Organic Furnishings are estimates. We are not liable for the consequence of any delay. We will make every effort to keep you informed of any delays.
e) Any delay of part of an order against an estimated delivery date does not entitle the buyer to cancel the order.

8. Cancellations:
a) Whilst every effort will be made to accept the cancellation this can only happen if cancellation is made prior to any cutting of fabric or production of furniture commencing. If cutting or production has begun then a 50% deposit will be kept.
B) For bespoke fabrics cancellation is not possible if product has already gone into production.
c) Cancellations should be made in writing.

9. Returns:
a) Returns cannot be accepted unless by prior agreement.
b) All faults or damages must be reported within 7 days of receipt of delivery.
c) Unauthorised returns will not be credited to the customer’s account.
d) Returns of bespoke fabrics, curtains, blinds and upholstered furniture will only be excepted where products are found to be faulty or damaged on receipt of products. It is the buyer’s responsibilty to check for faults prior to signing for the products on delivery.
e) For curtains and blinds, if measurements have been taken by the buyer then it is the buyer’s responsibility to ensure that correct measurements are given when placing order. All measurements and instructions for curtains and blinds will require the signature of the purchaser prior to the order commencing.
f) For furniture it is the buyer’s responsibility to ensure that the measurements are suitable for the room or area it will be situated in. All measurements and instructions for upholstered furniture will require the signature of the buyer prior to the order commencing.
g) Fitness for purpose: the customer must satisfy themselves that any product supplied by Harlands Organic Furnishings is fit for the purpose for which the customer purchases it for.
h) For cushions and throws ordered through the website returns are accepted within 14 days of purchase. The item should be returned in unused condition in original packaging, with tags and receipts included. Please phone or email Harlands Organic Furnishings immediately to arrange return of a product or discuss any problems. Buyer will pay postal cost for returned items.

10. Claims:
a) Non-receipt of goods: Any claim for the non-receipt of goods must be made in writing within a maximum of 14 days from the date of the confirmed delivery date.
b) Errors and omissions: Customers should check all deliveries immediately for shortages, faults, damages or incorrect products.
c) The buyer must inform Harlands Organic Furnishings, in writing, within 7 days of the date of delivery of any errors or omissions.
d) No claim will be considered in any circumstances should the goods have been cut, modified, hung (in the case of wallpaper) or damaged by buyer in any way.
e) Claims for labour charges will not be accepted under any circumstances.
f) It is a characteristic of natural textiles and hand silk screened fabrics and wallpapers that variations in colour and texture exist as such claims for irregularities will not be accepted under any circumstances. To ensure exact colour matching it is advised to order quantities required for future use at one time.
